From time to time I receive enquiries from residents, particularly from the Southern Moreton Bay Islands, about what they should do if they believe their vehicle or other property has been damaged as a result of road condition, trees or other Council-related issue.
For your convenience, the official Compensation Claim Form and Claims Factsheet are attached to this page. These documents provide detailed guidance on eligibility requirements, the evidence needed to support a claim, and how claims are assessed. Claims are assessed in accordance with relevant legislation, and lodging a claim does not automatically mean compensation will be granted.
Making a Claim Against Council
If you have suffered a personal injury or property damage and believe it may have resulted from Council’s negligence, you can lodge a compensation claim for assessment.
Council assesses all compensation claims in accordance with the Civil Liability Act 2003 (Qld). An incident occurring on Council-owned or Council-managed land does not automatically mean Council is liable or that compensation will be payable. Each claim is assessed on its individual circumstances.
Before You Lodge a Claim
Residents may wish to first consider lodging a claim through their own insurer. In many cases, this can be a quicker process. If an insurer believes Council is legally liable for the loss or damage, the insurer may pursue recovery directly from Council.
How to Lodge a Claim
Step 1: Complete a Claim Form
Complete the Compensation Claim Form online or using the PDF claim form. Online claims generate a reference number which should be included when forwarding supporting documentation.
Step 2: Prepare a Letter of Demand
Your letter should include:
- What happened
- When and where the incident occurred
- Who you believe is responsible and why
- The outcome you are seeking
- Supporting evidence, such as photographs, invoices and repair quotations.
Step 3: Submit Your Claim
Claims can be submitted by:
- Email: Claims@redland.qld.gov.au
- Post: Redland City Council, Risk and Liability Services, PO Box 21, Cleveland QLD 4163
- Hand delivery to a Council Customer Service Centre.
For assistance with the claims process, residents can contact the Claims Team by emailing Claims@redland.qld.gov.au or calling 3829 8999.
Supporting Evidence
Providing clear evidence will assist with the assessment of your claim.
Personal Injury Claims
Where a personal injury has occurred, residents should provide:
- Photographs of the exact location where the incident occurred
- Photographs of the surrounding area
- Photographs of the injury where appropriate
- Medical receipts or invoices relating to the injury.
Property Damage Claims
Where property damage has occurred, residents should provide:
- Photographs of the damaged property or vehicle
- Original receipts or invoices
- At least two independent repair or replacement quotations
- Registration and ownership details where the claim relates to a motor vehicle
- Documentation supporting any expenses being claimed.
How Claims Are Assessed
To establish negligence, a claimant must demonstrate:
- Council owed a duty of care.
- Council breached that duty of care.
- The breach directly caused the loss or damage suffered.
Council cannot provide compensation solely on compassionate grounds. Compensation can only be paid where legal liability has been established.
Personal injury claims are independently managed by a third-party liability claims manager. Some property damage claims may also be referred to an independent claims manager as part of Council’s governance processes.
Assessment Timeframes
Most claims are assessed within approximately 25 business days. More complex matters may require additional investigation and may take longer to determine. Residents will be advised if further information is required or if additional time is needed.
